Why are software patents not allowed in India?

Software is not patentable due to its mathematical nature. Computer programs in India are considered a form of applied mathematics. Lines of code can be copyrighted – you cannot use the software without paying for it – but the basic idea of the software cannot be patented. For example, multiple companies can build accounting software using the same logic because there are only limited ways account books can be maintained. But the lines of code, for example, used with Freshbooks, can be copyrighted.

Does it mean software cannot be patented at all? That’s not the case. Software attached to a specific invention, for example software used in a robotic product that has been specifically written for that robotic product, can be patented.

Ericsson vs Intex – Section 3K

Intex (along with Micromax) had complained to the CCI that Ericsson was not allowing them to use its software technology without royalty. Ericsson wasn’t even disclosing the licensing terms. In that case, the Delhi High Court granted an injunction restraining Intex Technologies India Ltd. from manufacturing, assembling, importing, selling, and offering for sale mobile phones and devices that infringed Ericsson’s eight standard essential patents relating to Edge, 3G, and AMR technology. The court held that, “… any invention which has a technical contribution or has a technical effect and is not merely a computer program per se as alleged by the defendant and the same is patentable.”

Ferid Allani vs Union of India – Section 3K

Ferid Allani, a citizen of Tanisha, desired to get a patent on a “Method and device for accessing information sources and services on the web”, back in 2002.

He had filed a patent application No. IN/PCT/2002/00705/DEL (PCT filed on 17th July 2002). He wanted to patent a “Method and device for accessing information sources and services on the web”. He made the claim because the software was based on the device it was being run on.

Patents, all over the world, are tested based on their “technical effect” and “technical contribution”. The innovation can be patented if it can be proven that it has a technical effect on the outcome and it makes a technical contribution.

Unfortunately for Ferid Allani, the case went on for 19 years and finally, it was decided that he won’t get the patent because the claim was about the software, which, in most of the cases, is not patentable.

New guidelines on computer -related inventions – 2017

The new 2017 guidelines provide more clarity and consistency in the examination of computer-related inventions (CRIs). The intention is to apply the patentability criteria in a fair and consistent manner. The Indian patent office purposefully  insists that software unique to a particular hardware is patentable.
